Legal information

Terms and conditions

1. Provider and scope

These terms are intended for contracts between KLOSS Ventures GmbH, Eschenweg 6, 4052 Ansfelden, Austria, and customers for wedding website design and hosting, particularly consumers in Austria and Germany. Full provider details: legal notice.

No binding purchases can be made on the current concept site. This is a draft and does not become part of a contract simply by visiting the demo. Individually agreed terms take precedence.

2. Offer and contract

The website shows design examples, planned features and non-binding concept prices. A specific offer will state the scope, total price including applicable taxes, payment terms, duration and essential technical requirements before agreement. A contract is formed by acceptance of that offer. Agreed terms and consumer information will be supplied on a durable medium, such as email.

3. Scope, design and approval

The individual offer specifies design, languages, revision rounds, domain services, features and storage limits. Additional work requires separate agreement on scope and price. The couple supplies the content and receives a preview before publication. Approval does not remove statutory rights concerning defects.

The service covers the website, not wedding organisation or venue services. Requirements such as internet access, supported browsers and material limitations will be communicated before contract.

4. One payment, twelve months

The agreed one-off payment covers the stated services and twelve months of operation from activation. Activation is the agreed start of production access, communicated to the couple. A booked photo album follows the same term.

The contract ends at the end of that term without automatic renewal. Extension requires an express request and agreement on price, duration and scope. Statutory rights to end a contract for cause or defects remain unaffected.

4a. Custom domain and renewal prices

Every package includes a personal JA ATELIER address. Signature and Bespoke include setup and the first registration year of one available standard .at, .de or .com domain. With Essential this service costs an additional €49 including VAT. Premium or already registered third-party domains require a separate offer.

The domain is registered in the couple’s name. Its registration period starts at registration and is aligned with website activation during setup. The exact expiry dates are communicated before the order. Registration depends on actual availability and applicable registry conditions; the demo does not reserve a name. A later provider transfer is possible under the applicable domain rules.

For another twelve months following the current term, the proposed total prices including VAT are: website with booked features €69; website with booked features and custom standard domain €99; domain registration alone €49. Domain-only renewal does not extend the website, guest management or photo album. Website-only renewal does not extend a custom domain. Existing export and statutory content-return rights remain unaffected.

Renewals require an express request and agreement; no automatic renewal or recurring charge is created. Domain purchase and renewal payments are not credited towards the feature bundle. Where no extension or transfer is requested, the domain is not renewed on the couple’s behalf and may become available to third parties after expiry.

5. Individual features and package upgrades

Additional features may be offered separately or in packages. Before an order, the feature, total price, any credit for previous purchases and remaining term will be shown. Activation requires an express paid order.

Unless expressly agreed otherwise, a later feature purchase covers the remaining website term. It does not start or extend the twelve months automatically. Any credit for earlier purchases must be specified before the upgrade. Statutory refund rights remain unaffected.

6. Data, photos and usage rights

The couple and uploading guests retain rights in their content. JA ATELIER receives only the rights needed for design, storage, technical processing and the agreed display. Advertising or public portfolio use of private photos requires separate permission.

Users must have the required rights and lawful basis for the agreed use of submitted material. Album visibility, access, moderation and storage limits are specified in the offer or setup. Unlawful material may be restricted following review, with affected customers informed where legally permitted.

7. End of term, export and deletion

The couple should be able to export guest responses and photos before the service ends. Export scope and format, as well as deletion timing after the term, will be specified before contract. The service is not an indefinite photo archive; keeping your own copies is recommended. Statutory rights to receive content remain unaffected.

[Before sales: specify post-contract export access, deletion deadlines for live guest data and photos, and maximum backup retention. Implement these rules technically.]

Records subject to statutory retention will be retained only for the relevant purposes. The production service will have its own appropriate privacy information.

8. Operation, updates and defects

JA ATELIER provides the agreed service throughout the term and complies with statutory conformity and update duties, including security updates. Planned maintenance will be communicated where possible and disruption kept low. Specific availability guarantees apply only where expressly agreed.

Statutory remedies apply to defects, including where relevant restoration of conformity, price reduction and termination. These terms do not restrict statutory liability. Changes affecting agreed use require compliance with applicable law and the required information and rights.

9. Withdrawal

Consumers may have a statutory right of withdrawal for distance contracts. The separate notice and model form form part of the information to be supplied before contract.

An early start requires a separate express request where legally required. Personalised design or initial activation of an ongoing digital service alone does not remove withdrawal rights. Statutory defect remedies remain unaffected.

10. Guest privacy

The applicable service-specific privacy information governs processing. Before production use, the roles of the couple, JA ATELIER and technical providers will be determined and a processing agreement concluded where required. Special categories of data, such as allergy-related health information, need an appropriate legal basis and separate assessment.

11. Applicable law and disputes

Austrian law applies, without depriving consumers of mandatory protection under the law of their habitual residence that would otherwise apply. Courts are determined by applicable law; these terms do not impose exclusive Austrian jurisdiction on consumers.

Contact details and the dispute-resolution statement still to be completed are in the legal notice.
